These Terms and Conditions (“Terms”) govern your access to and use of the website located at reactsportsmed.com (the “Site”), and your purchase or use of any services, programs, memberships, educational offerings, or content made available by REACT (collectively, the “Services”).
Please read these Terms carefully. They include a limitation of liability, an assumption of risk, and a dispute resolution provision that affect your legal rights.
Acceptance of these Terms
By accessing the Site, creating an account, scheduling an appointment, purchasing a service, enrolling in a program, making a donation, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference.
If you do not agree to these Terms, do not use the Site or the Services.
If you are entering into these Terms on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.

Medical disclaimer
The content on this Site is provided for general informational and educational purposes only. It is not medical advice, and it is not a substitute for diagnosis or treatment by a qualified healthcare provider.
Viewing the Site, reading our content, or contacting us through the Site does not create a physician-patient, provider-patient, or therapist-patient relationship. Such a relationship is formed only after you have been formally evaluated and accepted as a patient or client, and have completed the applicable intake, consent, and agreement documents.
Always seek the advice of your physician or another qualified health provider with any questions you may have regarding a medical condition, symptom, injury, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read on the Site.
Individual services described on the Site, including but not limited to diagnostics, laboratory testing, hormone therapy, peptide therapy, ozone therapy, hyperbaric or hydrogen therapy, photobiomodulation, and other treatments, are available only where clinically appropriate, only following evaluation by a licensed provider, and only as permitted by applicable law. Not all Services are available to all individuals.
Statements on this Site have not been evaluated by the U.S. Food and Drug Administration. No Service or product offered is intended to diagnose, treat, cure, or prevent any disease.
No emergency services
The Site and Services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site, email, text messaging, or any contact form to report an emergency or an urgent medical concern.
We do not monitor the Site or our messaging channels continuously and cannot guarantee that any message will be reviewed or responded to within any particular timeframe.
Assumption of risk
Physical training, rehabilitation, movement, manual therapy, and recovery activities involve inherent risks, including but not limited to muscle strain, sprain, joint injury, fracture, aggravation of an existing condition, cardiovascular events, and in rare cases serious injury or death.
By participating in any training, rehabilitation, or recovery Service, you acknowledge these risks and voluntarily assume them. You represent that:
- You have consulted, or have had the opportunity to consult, a physician before beginning any program.
- You have disclosed all relevant medical conditions, injuries, medications, and limitations to us.
- You will immediately inform staff of any pain, discomfort, dizziness, or change in your condition.
- You will follow instructions given by REACT personnel and will not exceed your own limits.
Participation in certain Services requires execution of a separate waiver, informed consent, and release of liability. Where a separate signed agreement conflicts with these Terms, that agreement controls as to the Service it covers.
Services and scheduling
Descriptions of Services on the Site are for general reference and may change. We do not guarantee that any particular Service, provider, technology, equipment, appointment time, or location will be available.
Appointments and cancellations
Appointments must be cancelled or rescheduled at least [NOTICE PERIOD] in advance. Late cancellations and missed appointments may be charged at [LATE FEE / FULL RATE]. Repeated missed appointments may result in suspension of Services.
Memberships and packages
Memberships, packages, and session credits are subject to the terms disclosed at the time of purchase, including any expiration date, auto-renewal schedule, and cancellation notice requirement. Session credits are [TRANSFERABLE / NON-TRANSFERABLE] and expire [EXPIRATION TERMS].
Fees, payment, and refunds
You agree to pay all fees for Services you purchase at the rates in effect at the time of purchase, plus applicable taxes. Prices are subject to change.
By providing a payment method, you authorize us and our payment processors to charge that method for all amounts due, including recurring charges for any subscription or membership until you cancel in accordance with its terms.
Except where required by law, or as otherwise stated in writing at the time of purchase, fees are [REFUND POLICY — e.g. non-refundable / refundable within N days]. Requests for exceptions may be directed to [BILLING EMAIL].
Insurance
[INSURANCE STATEMENT — e.g. REACT is an out-of-network / cash-pay provider; we do not bill insurance directly; superbills available on request.] You remain responsible for all charges regardless of whether any third-party payer reimburses you.
Donations
Donations made through the Site support [FOUNDATION ENTITY] and its programs. [TAX STATUS STATEMENT — e.g. a 501(c)(3) organization, EIN XX-XXXXXXX; donations are tax-deductible to the extent permitted by law.]
Donations are final and non-refundable except in the case of a demonstrable processing error, at our discretion. Contact [DONATIONS EMAIL] regarding any donation question.
Unless you designate otherwise and we accept that designation in writing, donations are unrestricted and may be applied to any program or operational need at our discretion. We do not guarantee that a donation will fund any specific individual, case, or outcome.
We do not sell donor information. Donor recognition is used only with permission.
Education and mentorship
Mentorship, immersions, team intensives, workshops, and other educational offerings are provided for professional development and informational purposes.
Participation does not confer any license, certification, credential, accreditation, continuing education credit, or authorization to practice any regulated profession, unless expressly stated in writing and accompanied by the issuing body’s documentation. Participation does not make you an employee, agent, partner, franchisee, or authorized representative of REACT.
You are solely responsible for practicing within the scope of your own license, training, and applicable law. Any application of concepts learned through our educational offerings to your own clients or patients is at your sole risk and professional judgment.
Enrollment terms, deposits, cancellation windows, and rescheduling policies are disclosed at registration and are incorporated into these Terms for those offerings.
Results and testimonials
Any testimonials, case descriptions, before-and-after accounts, or outcome statements presented on the Site reflect the experience of specific individuals under specific circumstances. They are not a promise, guarantee, or prediction of the results you will experience.
Outcomes in training, rehabilitation, and health optimization vary widely and depend on factors including diagnosis, severity, adherence, time, biology, and circumstances outside anyone’s control. We make no representation that any individual will achieve any particular result.
Intellectual property
The Site and its contents — including text, graphics, photographs, video, audio, layout, design, and code — are owned by REACT or its licensors and are protected by copyright, trademark, and other laws.
“REACT,” “Neuro Conditioning,” the REACT Blueprint, the REGULATE–EXPAND–AWAKEN–CREATE–TRANSFORM framework, “RECHARGE+,” and associated logos and marks are trademarks or service marks of REACT, whether or not designated with ™ or ®. You may not use them without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, publish, sell, modify, create derivative works from, or use for any commercial or training purpose any portion of the Site or our program materials without our prior written consent.
Materials provided in connection with mentorship or educational programs are licensed to you for your own professional use only and may not be redistributed, resold, or taught as your own.
Your submissions
If you submit a review, comment, photograph, video, question, testimonial, or other content to us or through the Site (“Submissions”), you grant REACT a non-exclusive, worldwide, royalty-free, perpetual, transferable license to use, reproduce, display, and distribute that Submission in connection with our business, in any media.
You represent that you own or control the rights to your Submission and that it does not violate any law or third-party right. Do not include the protected health information of any other person in a Submission.
We may remove any Submission at any time for any reason. We are not obligated to monitor Submissions and do not endorse them.
Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any portion of the Site, accounts, systems, or networks.
- Introduce malware, or interfere with or disrupt the Site’s operation or security.
- Scrape, harvest, crawl, or use automated means to collect data from the Site.
- Use the Site or its content to train a machine learning or artificial intelligence model.
- Impersonate any person, misrepresent your affiliation, or provide false information.
- Harass, threaten, or defame any person, including our staff, clients, or other users.
We may suspend or terminate your access to the Site or Services at any time, with or without notice, for conduct we reasonably believe violates these Terms or is harmful to others.
Privacy and health information
Our collection and use of personal information is described in our Privacy Policy.
Protected health information created or received in the course of clinical care is handled in accordance with the Health Insurance Portability and Accountability Act (“HIPAA”) and our Notice of Privacy Practices, which is provided separately and governs that information.
Information you submit through the Site’s general contact forms, email, or chat is not necessarily transmitted through a HIPAA-secure channel. Please do not send detailed health information, diagnoses, test results, or other sensitive information through those channels. Use the patient portal or contact us by phone instead.
Communications consent
By providing your email address or phone number, you consent to receive communications from us relating to your appointments, account, purchases, and donations. These are transactional messages and you may continue to receive them while you have an active relationship with us.
If you opt in to marketing communications, you may unsubscribe at any time using the link in any email or by replying STOP to any text message. Message and data rates may apply. Message frequency varies.
Third-party links and services
The Site may link to or integrate third-party websites, scheduling tools, payment processors, laboratories, patient portals, or donation platforms. We do not control those third parties and are not responsible for their content, practices, availability, or terms.
Your use of a third-party service is governed by that party’s terms and privacy policy. A link is not an endorsement.
Accessibility
We are working to make the Site accessible to as many people as possible, consistent with [STANDARD — e.g. WCAG 2.1 Level AA]. If you encounter a barrier to accessing any part of the Site, contact us at [ACCESSIBILITY EMAIL] and we will work to provide the information or service you need through an alternative means.
Disclaimer of warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, REACT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that content will be accurate, complete, or current.
This section does not limit any warranty or obligation that cannot be disclaimed under applicable law, and nothing in these Terms limits the professional obligations of licensed providers to their patients.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REACT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES WILL NOT EXCEED THE GREATER OF [AMOUNT] OR THE AMOUNT YOU PAID TO US IN THE [PERIOD] PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. These limitations do not apply to liability for gross negligence, willful misconduct, or personal injury to the extent such limitation is prohibited by law.
Indemnification
You agree to indemnify, defend, and hold harmless REACT and its officers, directors, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your use of the Site or Services, your Submissions, your violation of these Terms, or your violation of any law or third-party right.
Dispute resolution
Please read this section carefully. It may affect your right to bring a lawsuit or participate in a class action.
Before filing any claim, you agree to contact us at [LEGAL EMAIL] and attempt in good faith to resolve the dispute informally for at least [30/60] days.
If the dispute is not resolved, [ARBITRATION PROVISION — to be drafted by counsel: forum, rules (e.g. AAA), seat, cost allocation, class action waiver, and any carve-outs for small claims, injunctive relief, or medical malpractice claims.]
[NOTE FOR COUNSEL: medical malpractice and personal injury claims may be excluded from arbitration, and Texas Civil Practice & Remedies Code Ch. 74 notice and expert report requirements may apply to health care liability claims. Confirm interaction with any separately signed patient arbitration agreement.]
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Subject to the dispute resolution section above, you and REACT consent to the exclusive jurisdiction and venue of the state and federal courts located in [COUNTY] County, Texas.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, where the change is material, provide additional notice.
Your continued use of the Site or Services after the revised Terms take effect constitutes acceptance of them. If you do not agree, stop using the Site and Services.
General provisions
These Terms, together with our Privacy Policy and any separate agreement you sign for a specific Service, constitute the entire agreement between you and REACT regarding the Site and Services.
If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely.
Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
